Terms of Service
Last updated: August 27, 2026
These Terms of Service ("Terms") govern access to and use of Rentek - Rental Management System (the "Service"), a property and rental management platform, including its web application, admin and platform-admin panels, and mobile applications (collectively, the "Platform"), provided by [LEGAL COMPANY NAME] ("we", "us", "our"). By creating an account, logging in, or otherwise using the Platform, you agree to be bound by these Terms.
1. Who Can Use the Platform
The Platform is used by three broad categories of users:
- Companies — property management agencies and independent landlords who register an account to manage properties, tenants, leases, and finances.
- Company users — staff, admins, and landlords invited or created within a company's account.
- Tenants — individuals with an active or past lease managed through the Platform by a company, who are given access to view their lease, invoices, and make payments.
You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials, including any two-factor authentication recovery codes.
2. Accounts, Companies, and Data Separation
Each company's data (properties, tenants, leases, invoices, payments, and related records) is logically separated from other companies using the Platform. Company admins and staff can only access data belonging to their own company. Platform administrators (who operate the Platform itself, not any individual company) may access cross-company data solely for the purposes of operating, supporting, billing, and securing the Platform.
3. Subscriptions and Billing
Company accounts operate on a subscription plan, which may include a limited free trial. Paid plans are billed on a recurring basis via the payment method configured at sign-up (including mobile money payment, where available). Fees are described at the point of purchase. Failure to pay may result in suspension or limitation of access to the Platform for that company's account, subject to any grace period described at checkout.
4. Payments Processed Through the Platform
The Platform enables companies to collect rent and other payments from tenants using third-party payment processors, including M-Pesa (Safaricom), PayPal, and KCB Buni. We do not hold or custody these funds ourselves — payments are processed directly by the relevant payment provider and settled to the company's own configured payment account. Use of these payment methods is also subject to the respective payment provider's own terms.
5. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose, or to store or transmit content that is fraudulent, harassing, or infringes another party's rights;
- Attempt to access data, accounts, or company records that do not belong to you or that you are not authorized to access;
- Interfere with or disrupt the integrity or performance of the Platform, including through unauthorized automated access;
- Upload identity documents, images, or files that are not genuinely relevant to the tenancy or property record they are attached to.
6. Tenant Data Entered by Companies
Companies are responsible for the accuracy and lawfulness of tenant and property data they enter into the Platform, including identity documents, contact details, and lease terms. Companies must have an appropriate lawful basis (such as the tenant's consent or a lease agreement) for storing tenant personal data on the Platform.
7. Communications
By using the Platform, you agree that we and companies using the Platform on your behalf (where applicable, e.g. your landlord or property manager) may send you SMS and email communications relevant to your account, lease, invoices, and payments.
8. Termination
We may suspend or terminate access to the Platform for any account that violates these Terms, fails to pay applicable fees, or poses a security risk to the Platform or other users. Companies may close their account at any time; certain records may be retained after closure as described in our Privacy Policy or as required by law.
9. Disclaimers and Limitation of Liability
The Platform is provided "as is". While we take reasonable steps to keep the Platform available, secure, and accurate, we do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use of the Platform, including disputes between a company and its tenants or landlords.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the Platform or by email/SMS where practical. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of Kenya, without regard to conflict of law principles.
